Terms of service

Last updated: 23 October 2026

These terms apply to The Machine's hosted service at app.themachine.computer. The service is provided by Salesflare BV, Delacenseriestraat 14, 2018 Antwerp, Belgium, enterprise number 0564.785.369 ("we", "us"). By subscribing, you ("you") agree to these terms, the privacy notice and the data processing terms.

1. The service

You get a private server in the EU that runs OpenClaw and The Machine for you. It reads the sources you connect (such as mail, calendar and chat), keeps track of what needs doing, and drafts replies and actions for you to approve.

There are two sizes:

  • Standard: €25 or $25 a month, excl. VAT.
  • Bigger server: €50 or $50 a month, excl. VAT, with more memory for heavier use.

The server is used only by you. We set it up, keep it updated, watch its health and restart it when it gets stuck. You manage it from your dashboard.

Included:

  • Enrichment. Company details for the organizations in your work, and job title, company, photo and location of your work contacts, within fair daily limits. They are for use inside The Machine only: your server looks them up for you, and you may not use the service to look up companies or people for anything else.
  • Connectors on request. We may build a connector you ask for. If you choose to share it, we may publish it as open source.

2. Accounts

You sign in with Google or Microsoft and protect your account with a second factor (an authenticator app or recovery codes). Keep these safe. You are responsible for what happens under your account.

You must be at least 18 and able to enter a contract. If you subscribe for a company, you confirm you may bind it to these terms. One account is for one person.

3. What you bring

  • Your AI model. The Machine uses an AI model you connect, such as ChatGPT or Claude, under your own agreement with that provider and at your own cost. That provider is not our subcontractor, and its terms and limits apply to you directly.
  • A Telegram bot you create, so The Machine can reach you.
  • Accounts you are allowed to connect. Only connect mailboxes, calendars and other accounts you have the right to use this way.

4. Prices and payment

  • Prices are per month, billed in advance through Stripe. All prices we state exclude VAT. VAT is added where it applies, depending on your billing country, and the final total including VAT is shown before payment. Businesses can enter a VAT number at checkout.
  • Your subscription renews every month until you cancel.
  • Free trial. A new hosted subscription starts with 7 days free, once per person: not if you had a hosted Machine, a subscription or a trial with us before. Your card is needed to start. Your first monthly payment is taken when the trial ends, unless you cancel before then. If you cancel during the trial, your Machine runs until the trial ends and you pay nothing. Fleet seats have no trial.
  • Changing size. Moving to the bigger server is charged right away for the rest of the month, pro rata. Moving down gives a pro rata credit on your next invoice. Your server restarts for a few minutes when it changes size. If our provider has no room for the bigger server, your server keeps its size, your plan goes back to standard, and what you paid for the bigger server is credited pro rata on your next invoice.
  • Discount codes. We may offer codes, such as a free first month. A code applies only as described when it is given, cannot be exchanged for cash and ends when its period ends. After that, the normal price applies.
  • Failed payments. If a payment fails, we email you and Stripe tries your card again. Your machine keeps running for 30 days. If the payment has still not gone through by then, your machine is paused: it stops, and its data is kept. It starts again once you pay. We remind you by email while the payment is open, and while your machine is paused. If it stays unpaid for 6 months after the pause, we cancel your subscription and delete your server and all its data; we warn you 30 days, 7 days and 1 day before. If Stripe ends your subscription for non-payment earlier, your machine stops then, and its data is kept until that same date.
  • Price changes. We tell you by email at least 30 days before a new price applies to you. You can cancel before then.

5. Canceling, refunds and withdrawal

  • You can cancel any time with "Cancel subscription" on your account page. Giving a reason is optional. Canceling takes effect at the end of the period you have paid for. Your machine keeps working until then, and we confirm the cancellation by email. Until then you can also take it back.
  • We do not refund partial months, except where the law requires it or as set out below.
  • Right of withdrawal (consumers in the EU). If you subscribe as a consumer, you may withdraw within 14 days of subscribing without giving a reason, using “Withdraw from contract here” on your Account page (or directly at /account/withdraw), or by writing to support@themachine.computer. The online form confirms your name, contract and confirmation email, then asks you to confirm withdrawal. We immediately save the notice and offer a downloadable receipt; an acknowledgment email follows without undue delay. If you expressly request immediate service at checkout, we refund what you paid minus the lawful proportional amount for service supplied at your express request before withdrawal. A deduction is allowed only if we gave the required information and received that request. Refunds are made within 14 days of your withdrawal notice, using the original payment method unless you expressly agree otherwise, without a refund fee. This right does not apply if you subscribe for your business. You may use this withdrawal form: “I hereby give notice that I withdraw from my subscription to The Machine, ordered on [date]. Name: [name]. Address: [address]. Date: [date].” Send it to support@themachine.computer (Salesflare BV, see section 1). We email a confirmation of the subscription and a complete copy of the agreed terms and notices.

6. Your data at the end

  • After your subscription ends, we keep your server and its data for 30 days, so you can come back or take your data with you. Then we delete them, backups included. For an unpaid subscription, see "Failed payments" in section 4.
  • Export, any time. "Export everything" on your account page gives you your whole setup in one file, so you can run The Machine on your own computer.
  • Backups. Your server makes an encrypted backup of your data each night, kept in the EU for about 3 months (7 daily, 4 weekly and 3 monthly). We use them to restore your server after a failure. They are a safety net, not a guarantee: keep your own copy of anything you cannot lose, for example with "Export everything".
  • Wipe, any time. "Wipe everything now" on your account page ends your subscription and deletes your server, its backups and all its data right away. Your account record follows after 30 days. This cannot be undone.
  • Invoices are kept as long as tax law requires.

7. Fair use

Do not use the service to:

  • break the law or anyone's rights, including privacy and data protection law;
  • send spam or unsolicited bulk messages;
  • attack, probe or overload systems, ours or anyone else's;
  • mine cryptocurrency, run unrelated workloads, or resell the server;
  • collect enrichment data for use outside The Machine, or build lists or databases from it;
  • get around limits, security measures or other people's access controls.

Heavy use that harms the service for others may be limited. If you break these rules, we may pause or end your machine. We tell you why, and where it is reasonable we first give you a chance to fix it.

To keep one server from harming others, every server has a few built-in limits: it can't send mail directly to other mail servers (port 25), and a burst of new connections far beyond normal use is slowed down. Your own mail goes out through your mail provider as usual.

When our hosting provider forwards a complaint about your server, or we see signs of an attack, spam or malware coming from it, we may pause its internet access right away, without warning first, because the provider can otherwise block addresses that other customers share. A pause keeps your server and all its data; you can still open your dashboard. We email you why, and you can tell us your side at support@themachine.computer. We lift the pause once the cause is fixed or the complaint turns out to be wrong. If the abuse is serious or keeps happening, we may end the service under section 12.

If you enable search by meaning, its EmbeddingGemma model is subject to the Gemma Terms of Use, including section 3.2 and the Gemma Prohibited Use Policy. You must comply with those restrictions when using the model. Copies of its terms and notices are retained on your server. This applies to that model, not a new approval requirement for your assistant.

8. Your content and other people's data

What your machine reads and writes stays yours. We use it only to run the service for you, as described in the data processing terms.

Your mail and calendar contain other people's personal data. For that data you are the controller: you decide what to connect and are responsible for having a lawful basis to process it.

9. You approve before anything goes out

The Machine drafts messages and actions. It sends a message or takes an outward action only when you approve it, or when you have set up a rule that allows it. You stay responsible for what is sent in your name.

10. AI output

The Machine relies on AI models. Their output can be wrong, incomplete or out of date, and it can miss things. Check suggestions before you rely on them, especially for legal, financial or health matters. The Machine is an assistant, not a replacement for your judgment.

11. Availability

We aim to keep the service running smoothly, but we do not promise any particular uptime and there is no service level agreement. Your machine can be briefly unavailable for updates, maintenance, size changes, or automatic restarts when it gets stuck. Third-party services it depends on, such as Google, your AI provider or Telegram, can also fail or change.

We may change or improve features over time. If we remove something essential to the service, we tell you in advance and you can cancel.

12. Suspension and termination

We may pause or end your service if you break these terms in a serious way, do not pay, or if the law or a security risk requires it. We tell you why. If we end the service without your fault, we refund any prepaid amount for the time not used.

We may stop offering the service as a whole with at least 60 days' notice. You can then export your data.

13. Open source

The Machine is open source under the GNU Affero General Public License v3.0 (AGPL-3.0-only). It runs on OpenClaw, under the MIT license. Other open-source components run under their own licenses. Those licenses give you rights to that software; these terms cover the hosted service we provide around it. The licenses and their notices are on the open-source licenses page.

14. Liability

  • We provide the service with reasonable care and skill.
  • Our total liability for any claim is limited to the fees you paid in the 12 months before the event that caused it.
  • We are not liable for indirect or consequential loss, such as lost profit, lost business or lost data you could have exported.
  • We are not responsible for services you bring yourself, such as your AI provider, or for actions you approved.
  • Nothing in these terms limits liability for fraud, intent or gross negligence, for death or personal injury, or any right you have as a consumer that cannot be limited by law.

15. Changes to these terms

We may update these terms. For changes that matter, we email you at least 30 days before they apply, and you can cancel before then. The date at the top shows the latest version.

16. Law and disputes

Belgian law applies. Disputes go to the courts of Antwerp, Belgium. If you are a consumer, you keep the protection of the law and the courts of the country where you live.

17. The Fleet

The Fleet is a beta. It lets your Machine and the Machines of your teammates (a Work Fleet) or the people you live with (a Family Fleet) ask each other short questions, such as who knows someone at a company.

  • You choose what is shared. Your Machine answers nothing until you allow it, per person and per kind of question, and it does not relay whole mail threads, messages or files. It can share the short answer, draft or task summary that you allow. You can change your rules or leave at any time.
  • Only share what you may share. You are responsible for answering only what you are allowed to share with your teammates, for example under your employer's rules or confidentiality you owe others.
  • Answers can be wrong. An answer reflects what another Machine has seen, which may be incomplete or out of date.
  • Owners and admins. The person who creates a Fleet is its owner. An owner or admin can invite and remove members. Removing someone, or leaving, takes effect at once: their Machine no longer asks or answers.
  • Seats paid by the Fleet. An owner can invite someone with a seat: a Machine the Fleet pays for. For seats, the Fleet owner (or the organization they act for) is our customer and pays for them; the member still uses their Machine under these terms and stays in control of its data. Some beta Fleets are free for a time; paid seats and self-hosted Network members use the prices and confirmations below.
  • What a Fleet costs. The owner pays for the Fleet, monthly. Prices exclude VAT, which is added where it applies; the final total including VAT is shown before payment. The prices are: in a Work Fleet €30 for a seat with a Standard server and €60 with a Bigger one; in a Family Fleet €45 for the first two seats together (€25 for only one, €25 more for each Bigger server among them) and then €25 Standard or €50 Bigger per seat; and, in a Work Fleet, €4 for each member who answers with a self-hosted Machine. A Family Fleet has room for 6 people, and a self-hosted member costs nothing in it. A member who already pays for their own hosted Machine stops paying for it once the Fleet pays for it as a seat. A seat added during a month is charged right away for the rest of that month, pro rata. A seat removed during a month is not credited; it stops at the next monthly invoice. The prices are on our pricing page.
  • No charge without your confirmation. We never start charging a Fleet without the owner's explicit confirmation of the amount. Every action that changes what a Fleet costs shows the amount and the new monthly total first, and only happens when you confirm it. A paid seat's server starts only once the Fleet is paid for. When a Fleet we made free is about to cost money, we email the owner 14 and 3 days before.
  • When a Fleet is not paid for. If a Fleet that costs money is not paid for (for example, nobody confirms the amount after a free period), we tell its owner and members. Its servers pause after 3 days, and in a Work Fleet the members lose its work features after 7 days. Everything resumes once it is paid for. After a failed payment, its servers follow "Failed payments" in section 4.
  • Moving your billing to a Fleet. If you already pay and join a Fleet, your Machine becomes a seat: at once in a Fleet we made free, otherwise once its owner confirms and pays for the seat. Your own subscription then ends at once, and the unused part becomes a credit on your account, not a refund.
  • Leaving with a seat. To leave a Work Fleet and keep your Machine, you start your own subscription first (same server, same data); or you leave and your server ends at once, as described in section 6 for a canceled subscription. If the owner removes you, the Fleet stops paying and you have 7 days to start your own subscription or export your data; then your server stops and ends the same way. You can export your data at any time.
  • Self-hosted Machines. You can pair a Machine you run yourself with your account, so it can be in a Fleet through the Network. Its key can be revoked on your Account page at any time. We only relay what it sends, as for hosted Machines.

18. Friends

Friends let two people add each other by exact username. Nothing connects until the other person accepts; either person can remove or block the other. Your rules for friends are separate from your Fleet rules. The questions and answers use the same Network: relationship context, warm introductions, meeting context and free/busy times. Free/busy answers contain busy time blocks, not event names, attendees or locations. You remain responsible for the short answers you choose to share.

Friends are free, for hosted and self-hosted Machines alike. If you started the former Network for Friends subscription, you can stop it on your Account page; it ends at the end of the paid period, and your username and friends stay. The consumer withdrawal rights in section 5 still apply.

19. Statutory service rights

EU consumers retain the legal guarantee of conformity for digital services. We must supply the service as agreed and provide the updates needed to keep it conforming during the subscription. If it does not conform, contact support: you may require it to be brought into conformity without charge, and, where the law provides, a proportionate price reduction or termination and refund. Our beta label, service disclaimers and liability limits do not remove those rights.

For a change to a continuing digital service beyond what is needed to maintain conformity, we need a valid reason, such as improving compatibility or reliability, must not charge extra for that change, and explain it clearly. If it negatively affects your access or use beyond a minor impact, we give advance notice on a durable medium and the statutory right to terminate free of charge within 30 days, unless continued unchanged conforming access is available without extra cost.

20. Contact

Questions about these terms: support@themachine.computer. To report a security issue: security@themachine.computer.

Your own assistant. It reads everything and only bothers you when it matters.
